General conditions of online sale of products by


Article 1 – Purpose and Scope

These conditions exclusively govern online sales by New Mauritius Hotels Limited (“Beachcomber Boutiques“) of the Beachcomber Boutiques site, to which access is free and open.

They apply to consumers established in Mauritius (excluding Rodrigues and the other peripheral islands).

Article 2 – Products

The products presented on the site are the subject of a description mentioning their essential characteristics.

The photographs are given for illustrative purposes and are not of a contractual nature.

Article 3 – Pricing

The prices of our products are indicated in Mauritian Rupees (MUR) all taxes included (VAT included), unless otherwise indicated and excluding delivery or transport costs.

Beachcomber Boutiques reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in effect at the time of validation of the order and subject to availability.

The products remain the property of Beachcomber Boutiques until full payment of the price.

Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.

Article 4 – Orders

The contractual information is presented in English and will be confirmed at the latest at the time of validation of your order.

Beachcomber Boutiques reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Article 5 – Confirmation of Order

Any order appearing on the beachcomberboutiques.com website implies acceptance of these General Conditions. Any order confirmation entails your full acceptance of these general conditions of sale, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction.

You declare to have perfect knowledge of it.

The order confirmation will be worth signature and acceptance of the operations carried out.

Article 6 – Payment

The fact of validating your order implies for you the obligation to pay the indicated price.

Article 7 – Cancellation of Order 

No order cancellations are allowed on the site.

A return can be considered by Beachcomber Boutiques only if the Customer receives a damaged package during delivery

In this case only, the Customer has a period of 7 days from receipt of the product to inform Beachcomber Boutiques on the site (box provided for this purpose)

The product must be in its original packaging and condition.

Return and resend are the responsibility of the customer.

Reimbursement will be made only by way of a voucher of the same value to be used on a future online purchase within 3 months (non-exchangeable or refundable).

Article 8 – Availability

Our products are offered as long as they are visible on the site with the quantities mentioned and within the limit of available stocks.

Article 9 – Delivery

The products are delivered to the delivery address indicated during the ordering process, within the time period indicated on the order validation page.

In the event of a delay in delivery, an email will be sent to you to inform you of a possible consequence on the delivery time that has been indicated to you.

In the event of deliveries by a carrier, Beachcomber Boutiques cannot be held responsible for late delivery due exclusively to unavailability of the customer after several appointment proposals.

We deliver throughout Mauritius

  1. Deliveries will be made from Monday to Friday from 9 a.m. to 5 p.m.
  2. Deliveries will be made within 5 business days of order confirmation
  3. The delivery costs will be Rs. 175 per confirmed order, across the island.
  4. Any invalid address or unavailability of customer reception will be re-invoiced at the cost of Rs 250.

Article 10 – Liability and Force Majeure

The products offered comply with current Mauritian legislation. Beachcomber Boutiques cannot be held responsible for any damage resulting from improper use of the product purchased.

Moreover, Beachcomber Boutiques cannot be held liable for any inconvenience or damage caused by the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

Any event or circumstance which is unforeseeable, unavoidable, external and beyond the control of the parties and which cannot be prevented by the parties will be considered as force majeure: the blocking of means of transport, government law or regulation, pandemic or epidemic, cyclones, fires, earthquakes, flood, lightning, shutdown of telecommunications networks.

All these cases will be considered as grounds for exemption justifying the non-performance or suspension of the obligations of the parties.

Article 11 – Intellectual Property

All elements of the beachcomberboutiques.com site are and remain the intellectual and exclusive property of Beachcomber Boutiques. No one is authorized to reproduce, exploit, redistribute, or otherwise use for any purpose whatsoever, even partially, elements of the site whether they are software, visual or audio.

Article 12 – Data Protection and Cookies

By accepting these conditions, the Client accepts the personal data policy herein provided, which is in compliance with the Data Protection Act 2017

We may collect the following information from you:

– Last name

– Contact details, including email address

– Other information relevant to the customer and the items purchased

We need this information to understand your needs and provide you with the required service, i.e. managing your order, improving services, sending promotional emails, if you have opted for this.

They can also be sent to companies that are responsible for the execution of the order as well as processing and payment thereof.

This information and data will be kept securely in order to comply with our legal and regulatory obligations.

We accept payment by credit cards. All payments are secured by SSL (Secure Socket Layer).

beachcomberboutiques.com processes payments through MIPS MyPay which does not store card details. MIPS MyPay is a payment ecosystem compliant with the PCI (Payment Card Industry) standard.

When you choose an online payment option, your card information and details are handled securely through the online payment interface.

Rest assured that your card is securely encrypted while traveling the internet.

Important note: It is the buyer’s responsibility to verify, within 48 hours, that the payment corresponds to what should have been paid and that the payment has been effected. No reversal of the payment can be effected by MIPS after 48 hours.

Article 15 – Governing Law

These conditions shall be governed by and construed in accordance with the laws of the Mauritius.
